By signing an offer and reservation receipt, the client deposits an agreed sum with Always Marbella, trading as Azalea Playa Inmobiliaria S.L., or an Independent Spanish Lawyer (hereinafter known as the reservation deposit).
With effect from the completion date the buyer assume all rights and obligations to the property.
Once the offer and reservation receipt is confirmed by the vendor, both parties or the legal representatives will sign the corresponding private purchase contract.
Once the offer and reservation receipt is confirmed by the vendor, the reservation deposit will become non refundable except special conditions described in the offer and reservation receipt or by non fulfilment by the vendor. In these events, the deposit will be refundable and the buyer representative may obtain legal compensation.
Should in not be agreed otherwise, the property will be delivered upon completion, free from any charges and tenants.
Expenses: each party is responsible for his/her own professional legal expenses. All expenses and taxes resulting from this purchase are payable by the buyer (VAT, Stamp Duty or Transfer Tax, Notary fees and Registry fees). The plus value tax is payable by the vendor, unless otherwise agreed.
The non fulfilment of the buyer or the vendor liabilities and therefore the non fulfilment of the private purchase contract will not mean any liability of Always Marbella, its agents or its employees since it is a contractual partnership that Always Marbella is not party.
